1.1. GENERAL LEGAL RESPONSIBILITIES
As citizens, teachers are expected to know the law. Courts act upon the maxim that ignorance of the law is no excuse. Although it is impossible to be fully familiar with all of the laws it is helpful to have some knowledge of those laws that relate to their work.
Every teacher owes a duty of care towards all students in their charge. Corporal punishment is never permissible. Teachers, by the very nature of their profession are exposed to particular obligations under the law.
The teacher’s functions involve the rights of others and the teacher is vulnerable to the extent that his/her work involves relationships with various people. His/her duties are subject to special obligations of which he/she is expected to have a reasonable working knowledge.
He/she should be able to recognise the existence of situations in which it is appropriate to obtain legal advice.
